Answers · Non-O Retirement Visa
I'm married to a Thai national: is the retirement visa the same as a marriage/spouse visa, and which should I use?
No, they are not the same visa. Both fall under the Non-Immigrant 'O' category, which is where the confusion comes from, but they exist for two completely separate purposes and carry different requirements. The right one for you depends entirely on what matters most in your situation.
If you would prefer to qualify on your own merits as the foreign applicant, tied to nothing but your own age and finances, and you are over 50, the retirement visa generally makes more sense. Your status stands on its own.
If you are under 50, or you are perfectly comfortable qualifying on the basis of your marriage, the marriage visa becomes the stronger option, and it comes with a meaningful advantage: the cash deposit and income thresholds are considerably lower than those of the retirement visa. The trade-off is twofold. First, the marriage itself must be substantiated every single year as part of the renewal. Second, and this is the more important structural point, the visa is issued purely on the basis of the marriage, which means your immigration status in Thailand becomes attached to your Thai spouse rather than to you alone.
For the vast majority of married applicants, that is completely fine and the lower financial bar makes the marriage visa the obvious choice. But some applicants specifically prefer to keep their visa status tied entirely to their own qualifications rather than to the relationship, and for those people, the retirement visa is worth the higher deposit.
There is real nuance in the specifics of the marriage visa requirements and how they apply to your exact circumstances, so this is a good one to walk through directly during your eligibility assessment before deciding which route fits you best.
